What is an expungement?
Expungement is the legal process through which an arrest or conviction may be erased from a person’s criminal record.

After expungement, no information related to the arrest or conviction may be disclosed, with certain exceptions. It allows you to start a new, fresh life.

While law enforcement officials may always have access to your criminal history, expungement can keep your record clean in the eyes of employers, schools, and the general public.

What records can be expunged?

Arrest records, criminal convictions, and juvenile adjudications can all be expunged in Kansas. Depending on the jurisdiction in which the arrest or conviction occurred, expungement may:

  • Not be available at all.
  • Be an option for arrests, but not for convictions.
  • Be an option only for certain criminal convictions.
  • Be an option only for arrests and/or convictions that occurred while the offender was a juvenile.
  • Be available only after a person is acquitted (cleared) of an offense (i.e., charges are dismissed).
  • Be possible only when a criminal conviction is reversed (i.e., after a successful appeal of the conviction).
